Acceptance of Terms
Agreement to Terms
By accessing or using the Daivgya platform — including our website at daivgya.com, mobile applications, and any related services — you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Eligibility
You must be at least 18 years of age to use Daivgya. By using our platform, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a prominent notice on our platform. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
Our Services
Nature of Services
Daivgya provides an online platform connecting users with verified astrologers, spiritual advisors, and wellness practitioners. Services include Vedic astrology consultations, tarot readings, numerology, birth chart analysis, puja bookings, and the sale of spiritual products.
Entertainment & Guidance Purposes
Astrological and spiritual services provided on Daivgya are intended for personal guidance, entertainment, and spiritual exploration. They do not constitute professional medical, legal, financial, or psychological advice. You should not make critical life decisions based solely on astrological readings.
Astrologer Verification
We take reasonable steps to verify the credentials and experience of astrologers listed on our platform. However, Daivgya does not guarantee the accuracy, completeness, or reliability of any reading, prediction, or advice provided by astrologers on our platform.
Service Availability
We strive to maintain 24/7 availability but do not guarantee uninterrupted access. We may suspend or modify services for maintenance, upgrades, or circumstances beyond our control without prior notice.
User Accounts
Account Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.
Account Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or use our platform in a manner that harms other users or Daivgya.
Payments & Refunds
Consultation Fees
Consultation fees are displayed clearly before you confirm a booking. All fees are in Indian Rupees (INR) and are inclusive of applicable taxes. Fees are charged at the time of booking confirmation.
Payment Processing
Payments are processed through secure third-party payment gateways. By providing payment information, you authorise us to charge the applicable fees. We do not store full payment card details on our servers.
Refund Policy
Refunds are governed by our Refund Policy, available at daivgya.com/refunds. In general, cancellations made more than 24 hours before a scheduled consultation are eligible for a full refund. Cancellations within 24 hours may be subject to a cancellation fee.
Disputes
If you believe you have been charged incorrectly, please contact us within 7 days of the transaction at [email protected]. We will investigate and resolve billing disputes in good faith.
User Conduct
Prohibited Activities
You agree not to: use our platform for any unlawful purpose; harass, abuse, or harm astrologers or other users; attempt to gain unauthorised access to our systems; scrape, copy, or redistribute our content without permission; impersonate any person or entity; or use our platform to transmit spam or malicious content.
Respectful Interaction
All interactions on Daivgya — including consultations, reviews, and support communications — must be conducted respectfully. We reserve the right to remove content and suspend accounts that violate our community standards.
Accurate Information
You agree to provide accurate birth details and personal information when requesting astrological services. Providing false information may result in inaccurate readings and is grounds for account suspension.
Intellectual Property
Our Content
All content on the Daivgya platform — including text, graphics, logos, images, audio, video, and software — is owned by or licensed to Daivgya and is protected by Indian and international intellectual property laws.
Limited Licence
We grant you a limited, non-exclusive, non-transferable licence to access and use our platform for personal, non-commercial purposes. This licence does not include the right to reproduce, distribute, or create derivative works from our content.
Your Content
By submitting reviews, feedback, or other content to our platform, you grant Daivgya a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with our services.
Disclaimers & Limitations
No Warranties
Daivgya provides its services "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be error-free, uninterrupted, or that results obtained will be accurate or reliable.
Limitation of Liability
To the maximum extent permitted by applicable law, Daivgya shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages.
Maximum Liability
Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid to Daivgya in the 3 months preceding the claim.
Governing Law & Disputes
Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
Dispute Resolution
We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies as provided under applicable Indian law.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
